I am the ebay seller.
First of all, WHICH photos are you talking about specifically? ALL of my items I am listing were items I won on different auctions. I sold the originals and had copies made, which I kept for myself and those are LISTED AS SUCH. No caveat emptor here. The current listings with photos are from lots in which I BOUGHT OR TOOK MYSELF (I have the NEGATIVES to prove it!!).
I have seen people copy my pictures from my listings and use them in their fotopic album AND webshots . Kstaspleton has used one of my pictuures for his site before I knew about it as well. I actually didn't mind, and he ended up giving me credit when I actually didn't need it, was just happy that he used one of the photos I obtained LEGITIMATELY.
I can provide a statement from the user confirming that I bought the images from them (they were actually 35mm slides and this excludes the postcards of course). I can even provide the listing number if need be. Also of note, these images are not copyrighted.

This is Darren (totemtreasures) and I am familiar with caperrrr, have even bought from him!!
Thanks, there are some nice items up, I have all the books any many photos, postcards and RPPC's of the ferries and BC Steamships (CPR).
I cannot believe I have to do this, but I am in the process of scanning the negatives of two of the auctions currently listed, as well as the ORIGINAL photo of the Nanaimo with a copy along side for comparison purposes. These will be available to view on my fotopic site shortly.
I simply ask (including Shane) that you look at what I have to prove my position. There are two sides to every story and you are simply not getting all the information to make an informed opinion.

Oh boy, do I feel stupid!!!!! I clicked on the link and I realize exactly what Graham was saying. My apologies to you Graham. I dropped the ball on this one. Yes, it appears that caperrrr has in fact taken your photos and is trying to turn a profit from them. That is indeed a low act to commit. I do not know how to enable this feature, but I know that there are some people who have their images so when you right click on an image to save it, a box will appear that states it is copyrighted and cannot be saved. If you figure out how to do it, please let me know!! Again, sorry for the screw up!! Regards, Darren P.S. If I could delete that first post I'd do it in a heartbeat. Yes, I finally got it. I think I have been on this computer too long... I was doing a little (OK, ALOT) of surfing as I am familiar with this page. I saw that someome mentioned my listings and scrolled down a bit further to read the post that I originally replied to. Obviously, I now know what was meant and still feel somewhat emabarrassed over my incorrect reation. (Again sorry Graham!) I reiterate my agreement that caperrrr is comitting a very inappropriate and unethical action by stealing (yes stealing) Graham's photos. I'm not sure anything can be done, aside from spreading the word and not buying any of their items. Using the pictures for a desktop is one thing, but to print and try to re-sell is totally over the line. By the way Graham, I had a look at your galleries and enjoyed them very much. Just wish that there was a way to write protect them so that this does not happen again. Going back under my rock until the sun comes up. Regards, Darren

Your immediate correction is apology enough. About Copyright, etc.: I am certainly anyting but a stickler when it comes to my intellectual property; in fact, when I first saw my pics on ebay I immediately felt flattered. That, though, was weeks ago, long past any reasonable grace-period for people trying to make money off of your intellectual property. Note: I have now reported this to ebay staff, and will now step back and let things resolve themselves; I generally have a policy of " Don't Sweat the Small Stuff," but I also consider almost a month of these auctions to be beyond " Small Stuff." Don't get me wrong (and I've posted about this recently), I leave those relatively-unprotected shots of mine on Webshots.com, with the original-size option (to be able to conform to any screen at the highest presentation quality), because I want people to be able to enjoy my work. The reason that my work is on the internet in the first place is that I want to promote the subject matter to the world, I want to inspire people to want to visit or read about my corner of the world. Graham: Thank you very much for your understanding. Thanks to the others who posted (Including the "digs") but this was the post I was waiting for. It makes this screw up much more bearable. What you have experienced, in having your photos stolen, has given me a "heads up" (As a seller) in regards to how I can do my part in keeping this user (caperrrr) from getting at others. I have dealt with this person before, but have not had a similar experience. Despite that, I have blocked this user from bidding on any of my auctions permanently. I will not do business with someone that profits at taking from a third party without consent or knowledge. Bad judgement and very bad practice. Let us know if you receive a resolution from ebay in regards to your matter. I, for one, am most interested in the outcome. Regards, Darren

Well, After all this and HMCS Nanaimo's reference to "Guest of the week", I decided to register and after an exhaustive search, could not find the intro. section so.......... I'm Darren. I got a rather humbling experience through computer illiteracy (see above). I pop on this site from time to time and have decided to join. I live on Vancouver Island and chose the user ID "bcfcbccsscollector", as that is exactly what I am. I collect items from BC Ferries and B.C. Coastal Steamships (C.P.R.) As well, I sell on ebay under the user "totemtreasures". I grew up in Victoria and remember many trips across the straight, including the days of the 2 video game section by the stairs to the upper decks! One of my better experiences have been getting into the drydock in Esquimalt for a rather up close view of the Queens of Saanich, Nanaimo and Cowichan. Since I do not have the money Bill Gates does, I sell on ebay mainly so that I can finance further additions to my collection. Currently I have many various items from BC Ferries and the CPR, including hats, epaulettes, stateroom keys, menus (Including one from the "City of Vancouver"), porcelain, lighters and many postcards and real photo postcards. Also I have an 11 X 14 aerial photo of the Queen of Esquimalt at the Esquimalt Shipyard. Initially, I collected CPR items, and started collecting BC Ferries afterward. I have sold to a few users on this board and wish I could get some of it back now!! I still have a few things I do not need and will list at some point. Also in my collection are two scale models, the "City of Vancouver", 1:96 scale as it was originally built in 1962, and the "Queen of Alberni" 1:208 scale and as yet uncompleted.
