The sad reality of this sentence is, under Italian law, Mr. Schettino has the right to two appeals and will not serve a day in jail, until those appeal processes have been exhausted which may take many months.

I'm sorry... if I'm reading this right you're insinuating that Mr. Schettino has no right to his appeals? How is he any different from any other member of society? At least under Italian law he will actually serve out his sentence (assuming appeals are upheld). In Canada, if he was even sentenced, he would have served a huge portion of his time by now and would have been released in a relatively short amount of time.

I wasn't insinuating that Mr.Schettino has no rights to appeal his conviction and sentence. Apparently Canadian and Italian criminal laws are different with respect to incarceration and appeals. In Canada, anyone convicted and sentenced to a prison term of two years or more is incarcerated immediately and held in custody while any appeal processes are undertaken. In Mr. Schettino's case, Italian law permits him to remain a free man while his defence takes advantage of his rights to appeal. I admit I am not a student of Italian criminal justice and don't know if their equivalent of our Crown Prosecutor has the mandate to also launch any appeals of a conviction and what bearing that may have on a convicted person with regards to remaining free while the appeal is heard or whether the convicted person would be taken into custody. In Canada, if you are the 'convict', it is your hope that an appeal on your behalf is granted by the Crown. The outcome of the appeal may or may not change your conviction or length of sentence. As an inmate, two things you do not want to hear is that the Crown Prosecutor is appealing the Court's decision and that the Crown has not granted your defense a leave to appeal. One thing is certain under both legal systems. The worst thing an convict can hear is that his appeal has been denied by the court whereas the Crown's request for an appeal has garnered favour with a higher court as they do grant leave to hear the Crown's appeal. Given that the Italian Prosecutors had been looking for a sentence of 26 years in prison, I assume Mr. Schettino doesn't want to learn that Italian Prosecutors have the power(s) to appeal a sentence.

Loss of life and the destruction of a beautiful ship was the price exacted by the actions of Captain 'Arrogance'. Does anyone know if he is actually serving his jail sentence or is he still involved in stages of the appeal process?
